CCO regulates chiropractic in the public interest. In some cases, this requires the formal investigation of a chiropractor’s practice. Under section 75 of the Professions Procedural Code (the Code), schedule 2 to the Regulated Health Professions Act, 1991, the Registrar may appoint investigators to carry out investigations on behalf of the Inquiries, Complaints and Reports Committee.
The investigator’s powers are described in sections 76 to 79 of the Code. An investigator may inquire into and examine the practice of the member to be investigated and has, for the purpose of the investigation, all the powers of a commission under Part 2 of the Public Inquiries Act.
An investigator may, on the production of his/her appointment, enter at any reasonable time the business premises of the member and may examine anything found there that is relevant to the investigation.
No person shall obstruct an investigator or withhold or conceal from him/her or destroy anything that is relevant to the investigation.
This section applies despite any provision to any act relating to the confidentiality of health records.
